Driving With Excess Alcohol

Posted on 1st February

If you have been charged with this offence it is most likely because you have been stopped driving by the police and provided a specimen that was in excess of the drink driving limit. If convicted, you will receive a driving disqualification, and could even receive six months imprisonment and a fine of up to £5000. Whilst things may appear hopeless and a disqualification of at least a year inevitable, this may not necessarily be the case. This is because the procedure that the police must follow in order to obtain the specimen is fraught with difficulties. Our Barristers are experts in examining the police procedures with a fine tooth comb in order to check that the correct ones have been followed. Any anomalies that are found may then lead to a legal challenge to the admissibility of the sample. It is the combination of an astute understanding of the law in this area and our Barristers’ ability to present a persuasive argument that has led to many such cases being dismissed.
